Why are search warrants in DUI cases not full proof?

The Tennessee trend for police investigating DUI’s is to get a search warrant if a suspected DUI person refuses to give blood. This tactic is used to prevent someone from simply  exercising their right to not agree to a search of their person.  Thus police use search warrants to infringe on a person’s Rights.

Specifically protecting people, the United States’ and Tennessee’s Constitution provide protections from the government from searches of their person.  These protections include that there must be probable cause to issue a search warrant by any magistrate.
